1) Acceptance of These Terms
By accessing or using the Site, submitting any form/survey, scheduling an appointment, or attending our online Travel Show, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Site.
2) What We Provide
45 Plus Vacations provides travel-related information, access to an online Travel Show, and—when eligibility requirements are met—access to promotional travel certificates offered in connection with attending the Travel Show. We may also present an optional travel club membership offer during or after the Travel Show.
3) Important: This Is Not a Sweepstakes or Lottery
Unless we expressly publish separate “Official Rules” for a specific sweepstakes, our Travel Show offer is not a sweepstakes, not a contest, and not a lottery.
Your promotional travel certificate is offered based on attendance and eligibility—not chance.
In other words: this is a travel certificate offered in exchange for attending an online meeting, subject to the terms and conditions described below.
If we ever run a true sweepstakes or drawing, it will have separate Official Rules that clearly explain how it works.
4) Eligibility (General)
To participate in the Travel Show or to receive promotional travel certificates, you represent that:
You are at least 18 years old (and the offer may be intended for adults 25+ depending on the specific promotion); and
You will provide truthful, accurate information; and
You meet any eligibility criteria stated in the funnel, form, survey, confirmation page, or Travel Show invitation.
We may require additional eligibility verification (for example, confirming identity, age, household/relationship status, and other criteria) before issuing any certificate.
5) Appointments, Attendance, and Rescheduling
Appointment times are limited and subject to availability.
We may confirm, reschedule, or cancel appointments for operational reasons (for example: capacity, technical issues, or staffing).
If you miss your appointment or arrive late, you may need to reschedule and may not be eligible for certain time-sensitive promotional items.
6) The Travel Show
The Travel Show is an online presentation (often hosted through Zoom or similar platforms) where we discuss travel topics and may present optional products or services, including a travel club membership.
No purchase is required to attend the Travel Show.
A purchase is not required to receive the promotional travel certificate if the offer states you qualify through attendance and eligibility.
We may provide Q&A and examples. Content may change over time.
Recording
The Travel Show may be recorded for training, quality, and compliance. By attending, you consent to being recorded to the extent permitted by law. If you do not want to be recorded, do not attend.
7) Promotional Travel Certificates (Core Terms)
If you qualify through attendance and eligibility, we may provide access to a promotional travel certificate. Certificate details vary by offer, but generally:
A) Certificate is promotional; no cash value
Certificates are promotional and not redeemable for cash, not a bank card, and not a general-purpose gift card.
Certificates are typically non-transferable and may be limited to one per household (unless stated otherwise).
B) Redemption window
Certificates commonly have a redemption/use window (for example, up to 18 months). The exact window will be stated at the time of issuance.
C) Availability, blackout dates, and restrictions
Travel certificates may have:
Limited availability, seasonal restrictions, or blackout dates
Advance booking requirements
Destination, length-of-stay, and travel window restrictions
Requirements that travelers meet minimum age or other conditions
D) Costs you may still be responsible for
Even when a certificate is provided, you may still be responsible for certain charges depending on the offer and supplier rules, such as:
Government taxes, port fees, resort fees, gratuities, security fees
Upgrades, add-ons, extra nights, premium room categories
Changes, rebooking fees, or supplier-imposed charges
Optional travel insurance (recommended)
Any “included airfare” language applies only where explicitly stated and may still exclude certain fees or optional upgrades.
E) Verification and forfeiture
We reserve the right to deny or revoke certificate eligibility if:
Information provided is inaccurate or misleading
Fraud, abuse, or duplication is detected
The Travel Show is not attended as required
Any certificate rules are violated
8) Optional Travel Club Membership Offer (No Obligation)
We may offer a paid travel club membership during or after the Travel Show. If you choose to purchase, additional membership terms and policies (including billing, cancellation, and benefits) will be provided at the time of purchase.
Buying a membership is optional and not required to attend the Travel Show or to qualify for promotional certificates when the offer states it’s based on attendance and eligibility.
9) “Best Price” or “Savings” Statements
Any examples, comparisons, or savings statements (such as “up to X%”) are illustrations and not guarantees. Pricing and savings vary based on destination, dates, inventory, supplier rules, and market conditions.
10) Communications and Consent (Email/SMS/Calls)
By submitting forms on our Site, you may request or consent to communications related to:
Scheduling and confirming appointments
Travel Show reminders and access instructions
Follow-up support and next steps for certificate eligibility
If you opt in to marketing messages (optional), we may send occasional promotional communications.
Message frequency varies. Message & data rates may apply. You can opt out of texts at any time by replying STOP. For details on how we collect and use data, see our Privacy Policy on the Site.
11) User Responsibilities and Prohibited Use
You agree not to:
Use the Site for unlawful purposes
Attempt to access systems or data you do not have permission to access
Abuse promotions (duplicate entries, fake info, automation/bots, or manipulation)
Interfere with Site performance or security
We may block access or disqualify participation for misuse.
12) Third-Party Platforms and Services
We may use third-party platforms for scheduling, video hosting (Zoom), forms, texting, analytics, and travel suppliers. We are not responsible for outages, errors, or acts/omissions of third parties.
Your use of third-party platforms may also be governed by their terms.
13) Intellectual Property
All Site content, trademarks, logos, text, graphics, videos, and presentation materials are owned by or licensed to TravHoldings LLC and are protected by law. You may not copy, reproduce, distribute, or create derivative works without written permission.
14) Disclaimers
THE SITE, TRAVEL SHOW, AND ANY PROMOTIONAL OFFERS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that:
You will receive any particular travel dates, hotel brand, cruise line, or availability
The Site will be uninterrupted or error-free
Any savings amount will be achieved
15) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAVHOLDINGS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, TRAVEL SHOW, OR CERTIFICATE.
OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100), OR THE AMOUNT YOU PAID US IN THE PRIOR 30 DAYS (WHICHEVER IS GREATER).
16) Indemnification
You agree to indemnify and hold harmless TravHoldings LLC and its owners, employees, contractors, and partners from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, violation of these Terms, or violation of any law or third-party rights.
17) Dispute Resolution and Arbitration (Protective Clause)
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.
Any dispute arising out of or relating to these Terms, the Site, the Travel Show, or promotional certificates will be resolved as follows:
A) Informal resolution first
Before filing a claim, email [email protected] with:
Your name and contact info
A short description of the issue
The resolution you want
We will try to resolve disputes informally within a reasonable time.
B) Binding arbitration & class action waiver
If informal resolution fails, you and TravHoldings LLC agree to resolve disputes through binding arbitration, not in court, except for claims eligible for small claims court.
You agree disputes will be brought only in an individual capacity and not as a class, collective, or representative action.
Arbitration will be administered by a recognized arbitration provider (such as AAA) under its consumer rules, unless otherwise agreed. The arbitrator may award the same remedies a court could award.
C) Governing law
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules.
18) Changes to These Terms
We may update these Terms at any time. Changes become effective when posted with an updated Effective Date. Continued use of the Site after changes means you accept the updated Terms.
19) Severability
If any provision is found unenforceable, the remaining provisions remain in full force.
